A BILL authorizing the state building commission to sell the land, together with the improvements thereon, known as the Morris Square building in Charleston, Kanawha County.

Be it enacted by the Legislature of West Virginia:
SALE OF PROPERTY.
§1. Land sale; description.
(a) The state building commission is authorized to solicit interest; enter into a contract for sale; conduct a sale by auction; and sell, grant and convey, for good and valuable consideration, as negotiated by the executive director of the state building commission, all of those certain lots or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, being known as Lot "A-1" containing 1.118 acres, more or less; and Lot "A-2" containing 0.587 acre, more or less; situate in the city of Charleston, Charleston east tax district, Kanawha County, West Virginia; which property is more particularly bounded and described in a deed dated October 29, 1996, from the Charleston building corporation to the state building commission of West Virginia; and recorded in the office of the clerk of the county commission of Kanawha County, West Virginia, in deed book 2399 at page 79. Any sale and conveyance of the property is subject to all restrictions, reservations, rights-of-way, easements, utilities, covenants, leases, exclusions and other matters duly of record affecting the property.
(b) The money obtained from the sale of the property shall be deposited in a special fund of the department of administration to be known as "the Morris Square property fund" and is to be used for improvements and renovations of the state capitol complex.
(c) The executive director is authorized to contract with an auction company to sell the property. The auction may be oral, silent or on the internet. The cost of the auction, as contracted by the executive director with the auction company, is to be paid from the proceeds of the sale.
(d) The property shall have a minimum bid price which shall be set by the executive director, regardless of the appraised value, for sale and conveyance of the property.
(e) The sale by auction shall take place no less than once a year until the time the property is successfully sold.
(f) In the event of sale by auction, no commissions will be paid to a real estate broker who was engaged by the director to sell the property.
(g) Notwithstanding anything in the code of West Virginia, one thousand nine hundred thirty-one, as amended, to the contrary, the provisions of this section prevail.
